1) About The Living Depot
a)Your purchase of goods from this website (website”) is subject to these Terms and Conditions. If you do not accept these Terms and Conditions, you must refrain from using this website or making a purchase from this website.
b)This website operated by The Living Depot (Puchong) Sdn. Bhd. (“us”, “our”, “we”, “TLD”). We are a private limited liability company registered in Malaysia with our business address at No. 15, 17 & 19, Jalan PU 7/4, Pusat Bandar Puchong Utama, 22km Jalan Puchong, 47100 Puchong, Selangor Darul Ehsan.
c)You and TLD may enter into a sale contract for the sale and supply of goods or services described in this website, by you making an offer to TLD via this website, to purchase the goods and services at the specified price, subject to these Terms and Conditions.
d)In these Terms and Conditions : -
· “you”, “user”, “member”, and “guest” means anyone who visits and/or uses this website.
· Reference to a “third party” in these Terms and Conditions includes a reference to any agent or contractor of TLD, or of any of its related entities, and any person engaged by any of them, in the creation, provision or maintenance of this website or in the fulfillment of Orders made through this website, and includes any of them.
· A reference to the “website” means www.thelivingdepot.com.my
· “Order” means a request made by you on our goods or services via this website to be supplied or delivered by us.
e) We reserve the right to revise these Terms and Conditions from time to time at our discretion. Such revisions will be effective immediately upon publication on this website. We recommend you review these Terms and Conditions each time you use this website before placing any order.
2) Guests and Registered Users
a) You may access and/or use this website as a guest or as a member.
b) If you would like to become a member of this website, you must provide your name and address, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details we may not be able to activate your membership or supply goods or services to you. You agree to keep your membership details current at all times by accessing your account via this website or by contacting our Customer Service Team at +6012-379 8144 or +6012-308 8144.
c) You will receive an email from us as soon as practicable after you create your membership account.
d) We only permit one registration per email address.
e) You must not use another member’s account without permission.
f) You must keep your password secure as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorized use of your password or account.
We reserve the right to terminate a member’s account without notice for any reason whatsoever including without limitation, if you have breached or we suspect you have breached these Terms and Conditions.
3) Legal Capacity
a) You must be eighteen (18) years of age or over to register as a member of this website or purchase goods or services from this website.
b) Any Order and/or purchase made by you using this website is an acknowledgement by you that:-
· You are the age of eighteen (18) years;
· You accept these Terms and Conditions;
· You agree that you have entered into a legal contract with TLD in relation to these Terms and Conditions;
· These Terms and Conditions and together with your Order are constitute the entire agreement between you and TLD for the supply of goods or services; and
· TLD reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an Order to be placed, for any loss or damage of any kind TLD may suffer as a result of a transaction entered into by a minor.
4) Orders
a) We recommend you carefully preview any proposed Orders before adding them to your shopping cart and proceeding with your Order.
b) Once an Order has been accepted by TLD, no cancellation of that Order is valid unless you receive our written communication permitting the cancelled Order.
c) Representations of goods or services for sale made by TLD via this website do not constitute an offer to sell but an invitation to treat.
d) You and TLD may enter into a contract for the sale and supply of goods or services by you making an offer via the website to purchase goods at the price advertised on this website by :-
· Placing an electronic Order for the goods or services using this website.
· You confirm the Order details in accordance with the procedure on the website.
· You making payment in full (plus any applicable delivery and handling charges) to TLD
· The acceptance of your order from TLD.
e) When entering into a sale contract via this website, you will be taken to have communicated your offer to purchase the goods or services only when :-
· Any and all requirements set out in these Terms and Conditions have been met.
· The electronic instruction containing the offer from you enters and is recorded in our database.
· Record is created and stored in our database.
· TLD receives in its account full payment from you for the goods or services (including any applicable delivery and handling charges) and confirmation of that payment is received by our company bank account as below :-

5) You acknowledge that :-
a) The transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by TLD for reasons beyond either parties’ reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications failure, or the omission or failure of third party website providers or systems.
b) To the fullest extent permitted by law, TLD is not liable to you in any way for any loss or damage of any kind, however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through the website, or any failure to receive an electronic instruction for whatever reason.
c) TLD may act on and process all completed electronic instructions transmitted or issued through the website without further consent from or reference to you.
d) TLD may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
e) You will receive an email or message from TLD as soon as practicable after you have confirmed your Order and made payment. If you have any questions regarding your Order you may contact our Customer Service Team. Please note this email does not constitute acceptance of your Order by us but merely confirms our receipt of your Order.
· If your Order is not accepted by TLD, TLD will notify you by telephone or email and arrange for a full refund of any payment made by you to be processed.
· TLD may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, goods or services on the website, or an error of any kind in or relating to your Order.
· Any representations made at any time about stock availability are accurate to the last known stock level and are subject to change. If TLD cannot supply particular goods, TLDP will notify you by telephone or email as soon as possible.
· TLD will be deemed to have accepted your Order on the first to occur of issue to you: of a tax invoice for the sale and the fulfilment of your Order.
· With regard to any Order placed by you for any customized goods (including without limitation furniture made to or incorporating a particular design, specification, colour, configuration, pattern or fabric) TLD will e-mail you a notice of acceptance following confirmation of receipt of your Order at which point the customized goods shall be ordered by us from our suppliers.
· Upon the sending to you of the notice of acceptance, TLD shall be deemed to have accepted your offer, following which no cancellation of your Order by you shall be permitted and no refund or no exchange shall be made by us in respect of such goods.

6) Price
a) Prices shown are in Ringgit Malaysia and include SST where applicable. Prices may not include delivery and handling charges. Prices are valid until amended or removed from this website and are subject to change at any time.
b) Each published saving in respect of goods or services is by reference to the lower of the recommended retail price of the manufacturer or the normal retail price of TLD.
c) Images of goods shown without any advertised price beside that image are not offered for sale.
d) Unless otherwise stated, accessories shown in any image of goods are not included in the price.
e) We reserve the right to correct any errors published on the website at any time.
7) Promotion
a) All promotions running in this website are subject to each promotion’s terms and conditions.
b) All promotions run independently and can’t be combined with other ongoing promotions unless otherwise stipulated.
c) Each discount / voucher / promo code (if any) can only be used once per transaction per account and cannot be combined with other ongoing promotions unless otherwise stipulated.
d) Each discount / voucher / promo code (if any) comes with expiry date and will end by 11.59pm on the specified date.
e) TLD reserves the right to hold or cancel any order which violates any promotion’s terms and conditions.
8) Payment
a) All payments must be made in full prior to delivery, including any applicable delivery or handling charges.
b) We have the following payment method for your convenient :-
i) Credit Card/Debit Card
Card payments are processed through third-party payment channels and the type of credit cards/Debit Cards accepted by these payment channels may vary depending on the jurisdiction you are in.
ii) Financial Process Exchange (FPX)
Financial Process Exchange (FPX) are processed through third-party payment channels and several banks are allow to select by using FPX. When you place an order with FPX you will be redirected to your own respective bank website. Then you need to login with your bank username and password in order to proceed the payment. FPX uses highly secured authentication, security credentials and certification standards to ensure security of all transaction.
c) To the extent permitted by law, we will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by you were a bank account is fraudulently used or is used in an unauthorized manner.
d) If there is a problem with your payment, we may contact you to make alternative payment arrangements. You will be liable for all debt collection costs where you fail to make payment for any order when payment is due.
e) Our payment gateway facilitates transactions between the you and TLD in an e-commerce setting. You agree to use our services only for lawful purposes and in accordance with these Terms and Conditions.
9) Supply and Delivery

10) Title and risk in goods
Title and risk in goods pass to you on delivery or collection and after full payment has been received by TLD .
11) Exchange, Return and Refund
Kindly refer to our “Exchange, Return and Refund Policy”.

13) Force Majeure
TLD will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to natural disaster, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.
14) Governing Law
The courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our website or any Order placed on the website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms and Conditions are governed by Malaysia law.
15) Severability
If any part of these Terms and Conditions are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these Terms and Conditions and the remaining terms and provisions of these Terms and Conditions will remain in force and constitute the agreement between you and TLD.
16) Transfer and Assignment
If TLD merges, sells or otherwise changes control of its business or this website to a third-party, TLD reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that TLD has collected from you and any agreements it has made with you.
17) Waiver
The failure by TLD to exercise or enforce any right or provision under these Terms and Conditions will not constitute a waiver of such right or provision. Any waiver of any provision under these Terms and Conditions will only be effective if it is in writing and signed by TLD.
18) Membership Rewards
a) The Membership Card (“MC”) is launched, issued and managed by TLD. The MC is only issued in digital form.
b) The MC is only applicable to an individual customer. When individual customer register at this website, the individual customer will automatically become a member. As our members, members can collect point from both walk in outlet and this website purchases.
c) i) MC points awards by the ways is : RM1 = 1 point based on the bill total amount.
ii) Members birthday’s months point awards : double points based on the bill total amount during the purchase three (3) days
before and after from the member’s birth of date.
Example : if the member’s birth of date is on 09/09/2024, the member will entitle
double points from 06/09/2024 to 12/09/2024 purchases (if any).
d) Point Redemption: Points can be redeemed for use in purchases at our walk in outlet or this website.
The conversion rate is: 1,000 points = RM10.00.
Minimum Redemption is a block of 1,000 points with minimum cash of RM10.
e) Point cannot be converted into cash or any other forms of money, regardless of the ways through which the points are earned.
f) Points are not deemed as any form of property; hence they are not any property over which you may exercise the full right of possession. Point cannot be transferred to other members. TLD may, in its sole discretion, adjust the point value or amend relevant provisions relating to points redemption without your prior consent.
g) You shall be responsible for your membership account, which is designated solely for your own use and cannot be transferred, given as a gift or inherited.
h) Use of the MC constitutes acceptance of these Terms and Conditions. Members of the MC shall be deemed to have read and understood all the terms and conditions. Members may call our Customer Service Team at +6012-379 8144 or +6012-308 8144 to discuss your concerns or doubts with us before your first use if you do not understand these Terms and Conditions.
